Terms of Service
These Terms of Service ("Terms") set out the conditions for use of the iOS app "DriveTrail" ("the App") provided by AI Vision Technology Co., Ltd. ("we" or "the Company"). By using the App, users ("you") agree to these Terms.
Article 1 (Applicability)
These Terms apply to all aspects of the relationship between the Company and users regarding the use of the App.
The purchase, download, update, refund, and other aspects of the App are also governed by the App Store terms and other related policies set by Apple Inc., in addition to these Terms.
Article 2 (Overview of the App)
The App is an application for recording, displaying, and managing vehicle driving routes, distances, speed, date/time, photos, and related data using GPS and other technologies.
The App allows users to display recorded driving data on a map, view it in calendar and graph formats, replay routes, export data, and more.
Article 3 (User Environment)
You are responsible for preparing, at your own expense, the device, OS, connectivity, Apple ID, App Store access, and other requirements necessary to use the App.
Some features of the App may require permission to access location, photos, notifications, motion, iCloud Drive, and other device functions.
Article 4 (Use of Location Data)
The App uses location data from your device to record driving routes, distances, speed, and related information.
The accuracy of location data may vary depending on GPS signal quality, device condition, OS specifications, surrounding buildings, tunnels, underground areas, mountainous terrain, weather, network conditions, and other factors.
Accordingly, driving routes, distances, speeds, travel times, and location data displayed in the App are provided for reference purposes only and do not constitute a guarantee of accuracy.
Article 5 (Data Storage)
Driving data, vehicle information, photos, and settings recorded by the App are stored on your device.
The App does not transmit or store recorded driving data, location data, speed data, photos, vehicle information, or other data on the Company's servers.
However, if you use the App's export, sharing, backup, or iCloud Drive features, data may be stored or shared outside your device as a result of your actions.
Article 6 (Data Management and Backup)
You are solely responsible for managing, storing, backing up, restoring, deleting, and transferring data recorded by the App, including when changing devices.
Data stored within the App may be lost if you lose, damage, reset, or change your device, or if you delete the App.
Because the App stores data only on your device and not on the Company's servers, the Company shall not be liable for any loss, corruption, unrecoverability, or backup failure of data stored on your device, except in cases of the Company's willful misconduct or gross negligence.
Article 7 (Export and Sharing)
You may export driving records and other data in formats such as GPX, KML, HTML, video, images, and others, and save or share them using the App's features.
Exported or shared data may include driving routes, location data, date/time, speed, photos, and other information related to your activity history.
You are solely responsible for reviewing the content, recipients, scope, and destination of any data you export or share.
Article 8 (Use While Driving)
You must not operate, look at, or change settings of the App while driving any vehicle, including automobiles, motorcycles, or bicycles.
Always operate the App after stopping in a safe location.
You must comply with road traffic laws and other applicable laws and regulations, and prioritize safe driving at all times.
Article 9 (Prohibited Conduct)
You must not engage in any of the following when using the App:
1. Acts that violate laws or public order and morals 2. Operating or looking at the App while driving 3. Dangerous driving, illegal driving, nuisance behavior, or other acts that endanger or harm third parties 4. Unauthorized modification, analysis, or reverse engineering of the App 5. Acts that interfere with the App or the Company's operations 6. Acts that infringe on the rights, privacy, honor, or reputation of third parties 7. Any other acts deemed inappropriate by the Company
Article 10 (Intellectual Property)
All copyrights, trademarks, and other intellectual property rights in the App and all content within it, including programs, designs, images, text, and logos, belong to the Company or the rightful rights holders.
You may use the App for personal or business record-keeping purposes, but you may not copy, modify, redistribute, sell, lend, or analyze the App itself.
Article 11 (Changes, Suspension, and Termination)
The Company may change the content, features, specifications, supported OS versions, or delivery method of the App as necessary.
The Company may also suspend or terminate all or part of the App due to changes in OS or App Store specifications, technical or operational reasons, or other unavoidable circumstances.
Article 12 (Purchase and Refunds)
The purchase price, payment method, billing, refunds, and related matters for the App are governed by the terms, conditions, and procedures set by the App Store and Apple Inc.
The Company is not responsible for payment processing, refund decisions, or account management carried out by Apple Inc.
Article 13 (Disclaimer of Warranties)
The Company does not warrant that the App is fit for any particular purpose, accurate, complete, useful, continuous, free from defects, free from data loss, or functional on all devices or OS environments.
The App is intended to assist with drive recording and does not guarantee accurate records for business, legal, insurance, accident analysis, or evidentiary purposes.
Article 14 (Limitation of Liability)
The Company shall not be liable for any damages arising from your use of or inability to use the App, except in cases of the Company's willful misconduct or gross negligence.
Even where the Company is liable, its liability shall be limited to ordinary and direct damages. The Company shall not be liable for special damages, indirect damages, lost profits, or damages arising from data loss, except in cases of willful misconduct or gross negligence.
Where these Terms are rendered void or limited by the Consumer Contract Act or other applicable laws, such laws shall prevail.
Article 15 (Changes to Terms)
The Company may revise these Terms as necessary.
If the Terms are revised, the Company will publish the revised content within the App, on the Company's website, or through other means deemed appropriate by the Company.
Unless otherwise specified by the Company, revised Terms take effect when posted on the Company's website or other relevant location.
Article 16 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising in connection with the App or these Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's location as the court of first instance.

Privacy Policy
AI Vision Technology Co., Ltd. ("we" or "the Company") sets out below its policy regarding the handling of user information in the iOS app "DriveTrail" ("the App").
1. Information collected and used
The App uses the following information solely to provide its features:

This information is used to provide features such as route recording, map display, calendar view, graphs, replay playback, photo mapping, backup, and export.
2. Where information is stored
Information recorded by the App is stored on the user's device.
If the user uses the App's backup feature, backup data may be saved to the user's own iCloud Drive. We do not access data stored in the user's iCloud Drive.
3. Transmission to our servers
The App does not transmit recorded location data, driving routes, speed data, photos, vehicle information, or any other data to our servers.
4. Sharing with third parties
We do not provide location data, driving routes, photos, vehicle information, or any other data recorded in the App to third parties.
This does not apply where required by law.
5. Use of external services and OS features
The App may use iOS features such as map display, location access, iCloud Drive storage, Live Activity, and widgets.
The specifications and privacy policies of OS and services provided by Apple Inc. may apply to the use of these features.
6. Export and sharing features
The App allows users to export drive records in formats such as GPX, KML, HTML, and mp4, or share them with other apps or services.
The user is solely responsible for managing any data they export or share.
7. Analytics and advertising
The App does not use any advertising SDKs, analytics SDKs, or SDKs for tracking purposes.
